Are You Really Covered In Case Of An Accident?

A week does not go by, where individuals come into the Law Firm and say:

“I got into an accident and I think I HAVE FULL COVERAGE ON MY BIKE.”

What usually this means is that the rider has Collision Coverage to pay for property damage or Comprehensive Coverage for things like hail damage or vandalism.

But it is important to understand that that Comprehensive/Collision Coverage doesn't protect you if you are INJURED!

And due to the fact that riders are even more exposed to bodily injury on a motorcycle, it is important to make sure, double check. triple check that you have the right insurance coverages for injuries and not just for property damage.

The most important coverage you can buy as an owner of a Motorcycle is Uninsured/Underinsured Motorist Coverage. UM/UIM

Never reject it.

Insurance Industry Claims History Documentation over the last 20 years clearly documents that the majority of all motorcycle claims are for riders who are hit by uninsured drivers.

Uninsured/Underinsured Motorist Coverage protects you if you are injured by a driver who either didn't have any insurance or didn't have enough insurance.

Buy as much UM coverage as you can possibly afford.

Because Texas Law only requires the at-fault driver to have coverage in the amount of $30,000, thus UM coverage is critically important.

For example, a common injury that we see in motorcycle accidents is a fractured tibia/fibula requiring surgery. $30,000 of liability coverage on the at-fault driver does not cover the cost of this surgery, let alone your lost wages, ambulance/emergency room visit, and follow-up physical therapy.

Take 5 minutes today and double check if you have UM coverage.

The next type of coverage you need to make sure you have is PIP or Med-Pay Coverage.

I recommend to my clients PIP over Med Pay, for you if ever have an accident and make a PIP claim, the PIP claim dollars paid to you are not subrogate-able or set off.

Meaning, if some At-Fault driver caused your accident, your PIP Insurance Carrier is not allowed to pay you in one hand and then take the same amount back from you out of the At-Fault Persons coverage.

However, if you have Med-Pay, your insurance company can pay you under the Med-Pay terms and then take the same amount back from you under the Liability coverage.

Additionally, PIP will pay lost wages to you if any occur as a result of an accident, Med Pay will not. Thus, always choose PIP over Med-Pay.

Both PIP and Med-Pay are a type of coverage that will pay your medical bills regardless of whether you were at fault for a crash or whether someone else was at fault. This type of coverage will protect your passengers too.

THE DOs AND THE DON'Ts AFTER A MOTORCYCLE ACCIDENT

The Dos

1) Do seek medical attention.
2) Do get at least one estimate on the repair or replacement of your bike.
3) Do take down all info on any and all witnesses and that day or soon after, interview the witnesses.
4) Do call your insurance agent.
5) Do review your coverage - specifically the "Coverage" and "Exclusion" sections of your policy.
6) Do keep detailed notes of all conversations with insurance company representatives, get names, phone numbers and job titles.
7) Do take pictures of your bike and the other vehicle, injuries to your body and photos of the accident scene.
8) Do be honest. Failing to be candid with your insurer might invalidate your policy.
9) Do keep all receipts of all medical expenses, repair matters and any and all expenses incurred in connection with your claim
10) Do consider calling our Law Firm or any other Law Firm that has the necessary experience to protect your rights and specific knowledge on how to fight the insurance companies.

The Don't s

1) Don't give a recorded or written statement to anyone, without an attorney representing your interest. Remember you are not required to give a statement. And do not admit fault.
2) Don't automatically accept the estimate or appraisal of your motorcycle or property given to you by the insurance company.
3) Don't sign any releases or waivers of any kind until you obtain legal advice.
4) Don't accept any check that says "final payment".
5) Don't let the clock run out - thus don't ignore time limits. You only have two years before the statute of limitations expires, on most injury cases occurring in Texas.
6) Don't forget that you have a contract with your insurer. Your insurer has a legal obligation to provide the coverage it promised to you.
7) Don't forget to followup with your doctor or medical provider.
8) Don't assume no one is watching you, especially if you have a large claim. On a regular basis we have found that insurance companies will try to lessen or destroy victims' cases with video tape of the victim.
9) Don't just hire any lawyer, make sure the firm your select has the experience in this area of the law, that they only will charge you a fee, if and only if, they win your case and the only way the case can be settled is if you any proposed settlement.
10) Don't take your bike for repairs just anywhere. Chose a Dealership that has experience in properly repairing your make and model of bike.

Distracted Drivers are the Cause of Most Accidents

According to the Texas Department of Transportation, the East Texas rural roads are deadlier than traveling on other major thoroughfares and interstates. This news is released as new crosses are being erected at the scene of yet another fatality near Longview.

Even though the number of fatal crashes has gone down in recent years, over 50% of the fatalities in the surrounding five counties around Longview since 2007 have been one vehicle accidents. This has led the Department of Transportation to conclude that distracted driving is the culprit in these collisions.

Further evidence in support of this conclusion is the fact that only one death occurred in more than 90% of the fatal accidents. In the five county area including Gregg, Rusk, Harrison, Panola and Upshur, there has not been any single accident since 2007 that resulted in more than three fatalities.

Jean Dark, with the Texas Department of Public Safety (TDPS), stated that the reason is simply because most accidents occur on farm-to-market (FM) roads and involve only one car or pickup striking a tree, after leaving the road. This contrasts with multi-vehicle crashes on interstates. She explains that the difference is the tremendous impact that occurs when a vehicle strikes a stationary object such as a tree. It just "doesn't give like another car would."

The Department's data indicated that 54% of all the accidents in the five county Longview area involved a single vehicle leaving the road, striking an object or flipping over. Only 38% of the wrecks involved two vehicles.
Dark said drivers just have to "pay attention to driving," because if someone isn't, it "can change your life." For example, on two-lane FM roads, the oncoming traffic is separated from you by nothing more than a center stripe. You trust the other driver is paying attention and will stay on their side of the road. Unfortunately, sometimes they are distracted and they cross over into your lane.

Accidents resulting in fatalities have been around long before all of the gadgets we now have to distract us, such as cellphones, smartphones, iPads, iPods, headphones and GPS, just to name a few. Nationwide statistics show that distracted driving is one of the major causes of traffic fatalities. The TDPS data indicates that there were over 100,000 vehicles involved in accidents caused by distracted drivers in 2009 and new data is expected to confirm that those figures are continuing to rise.

Many of the crashes are the result of drivers trying to text message while driving. In 2009, the Texas Legislature passed a law which prohibits the use of any type of wireless device in a school zone. Another attempt to get a law passed to ban texting while driving is going to be on the table again during the 2013 legislative session. In 2011, Governor Perry vetoed a texting ban proposal.

Studies have shown that the use of a cellphone and texting while driving are equally, if not more dangerous, than driving while intoxicated.

SOMETHING MOST OF US ALREADY KNEW

Did you know that over 80% of auto accidents involving motorcyclists and automobiles or trucks, the motorcycle is NOT at fault?

A recent study confirms that the vast majority of motorcycle accidents are caused by inattentive drivers of cars and trucks.

More and more automobile drivers are failing to pay proper attention to the road, to traffic and fail to recognize the unique qualities of motorcycles.

The findings can be backed up in part, by the fact that motorcycles can stop much faster than cars and there are more distractions when driving a car.

It is important to note that motorcycles are more difficult to see than cars and, while not seeing you is no excuse for negligence, it will often be the cause of the accident. Driving defensively, includes the concept that the other guy does not see you.

It is interesting, though, that many automobile drivers often can see the motorcycle "cop" from far, far away, but they fail to notice you the rider.

Over the last 21 years of our law firm, we have found that the riders of motorcycles to be usually "more defensive drivers."

You also find in most cases the biker or motorcyclist to be more aware of the traffic environment and his or her surroundings.

In more and more cases we are finding that the operator of automobiles or trucks to be subjected to more distractions such as texting and driving, cell phones, stereos, DVD players, and conversations with passengers.

In most cases you will not find these types of distractions for the motorcyclist.

10 Worst Insurance Companies in America

The American Association of Justice (AAJ) named the "Ten Worst Insurance Companies in America" and the AAJ set forth how these 10 Worst have improperly raised premiums, denied valid claims and refused to insure those who need it most.

ALLSTATE: There is no greater poster child for insurance industry
greed than Allstate. According to its’ CEO “our obligation is to earn a
return for our shareholders.” Unfortunately, that dedication
to shareholders has come at a price to policy holders. According to
public records, the company systematically placed profits
over its own policyholders. The company that publicly
touts its “good hands” – in reality plays hard ball.

UNUM: Unum, one of the nation’s leading disability insurers, has
long had a reputation for unfairly denying and delaying
claims. Unum’s claims-handling abuses have consistently
been the subject of regulator and media investigations.

A.I.G.: The world’s biggest insurer, AIG has a long history of
claims-handling abuses for both individuals and business
clients. AIG executives have also come under fire
for opportunistically seeking price increases during
catastrophes. Now the company has been labeled “the
new Enron” because of charges of multi-billion dollar
corporate fraud.

STATE FARM: As the biggest property casualty insurance company in
America, State Farm has become notorious for its deny
and delay tactics. In many cases, the company has gone
to extreme lengths to avoid paying claims, including
forging signatures on earthquake waivers after the deadly
Northridge earthquake, and altering engineering
reports regarding damage after Hurricane Katrina.

CONSECO: Conseco sells long-term care policies, typically to the
elderly. Unfortunately, Conseco uses the deteriorating
health of its policyholders to its advantage because the
company knows if it waits long enough to pay out
claims, its customers will die.

WELLPOINT: WellPoint has a long history of putting its bottom line
ahead of the welfare of its policyholders and their health
care providers. Investigations have shown that
Wellpoint routinely cancels the policies of pregnant
women and chronically ill patients.

FARMERS: Swiss-owned Farmers Insurance Group consistently
ranks at or near the bottom of homeowner satisfaction
surveys. Given its tactics towards its policyholders, that
comes as no surprise. The company even created an
incentive program that offered pizza parties to adjusters
who met low payment goals to claimants.

UNITED HEALTH: UnitedHealth is plagued by accusations that its greed
has endangered patients. Physicians report that reimbursement
rates are so low and delayed by the company
that patient health is compromised. Money that should
have been spent on medical treatment for policyholders
has instead gone to the company’s former CEO.

TORCHMARK: Torchmark has preyed upon low-income
Southerners for over 100 years. Torchmark is the holding
company for a variety of subsidiaries offering low
cost burial insurance, cancer insurance, life insurance,
and similar policies.

LIBERTY MUTUAL: Like Allstate and State Farm, Liberty Mutual hired consulting giant McKinsey & Co. and adopted deny, delay,
and defend tactics. The company has also gone one further
than simple claims-handling abuses by indulging
in what regulators allege is systematic bid-rigging.

Let It Rain - Riding Motorcycles When It's Wet.

Assuming it will ever rain in Texas.

Tip 1: Buy the Right Motorcycle Gear.
a. High quality rain-suit (you get what you pay for)
b. Waterproof boots that cover your ankles (so water doesn't seep in from above)
c. Waterproof gloves, preferably with one of those squeegees on the thumb to clean your visor with.
After you have the right gear, riding in the rain is less of a pain in the ass.

Tip #2: The first 15 minutes of a rainstorm are the slickest.
Weeks or months of traffic and vehicles deposit oil, brake fluid, fuel and crud on the road.
We recommend: Break for gas, a coffee, whatever when it first starts raining.
Can't pull over? Just drive extra careful and slow during the start of any rain shower.

Tip #3: Avoid shiny-smooth surfaces.
Avoid metal - train tracks, man hole covers, metal grates on bridges, etc. Less obvious is anything painted: lane lines, turn arrows, etc.

Tip #4: Slow Down!
Reason - brakes are less effective, thus it is going to take much longer to stop when it's wet than when it's dry. And when it boils down to it would you rather start fish tailing at 25 miles an hour or 50 miles an hour?

Tip #5: Ride (3 car links - behind one of the rear wheels of the car in front of you.)
The car's wheel in front of you basically acts like a plow pushing all of the water on the road out of the way for a brief period of time. Take advantage of that (slightly) dryer pavement.

Tip #6: Unsure about traction? Test it!
Traction is usually any rider's biggest concern in the rain. Surprisingly though, wet pavement can offer significantly more traction than some riders think. If you're concerned -- test it.
While riding at a moderate speed on a straight, level surface, with no traffic, feel for how much traction you have with your rear wheel (not your front!) by testing your rear brakes and the braking distance.

Tip #7: Use a full face helmet, or buy a detachable face shield.
Rain drop's hurt at 50 mph. In fact, you will think might hailing. If you ride with an open face helmet you'll want to get something to protect your face. Don't get caught with nothing to cover up with, always have a bandana.

Tip #8: The Rule of One Action.
Follow the Rule of “One Action" – thus break up tasks.
In normal conditions, we put our tires through many different stresses (or actions):
• We accelerate while turning. (separate into 2 separate actions)
• We downshift while coming into a turn. (two actions)
• Shifting weight while turning and accelerating (three actions)
In the rain, you should focus on only putting your tires through one action at a time.
In other words, accelerate (one action) after you make a turn (one action). Downshift (one action) before you start to turn (one action). Don't combine actions when it is raining.

“We’re getting stuff ready for our black leather jacket collection,” says Jim Fricke, clapping his hands and briskly rubbing them together.

The curator of the Harley-Davidson Museum is upbeat starting our group tour, the first leg of a press junket through Harley-Davidson’s operations in Wisconsin. MotoUSA is along for the ride, ready to walk through the 110 years of history celebrating America’s most successful motorcycle brand.

Harley-Davidson is a giant, the giant, of American motorcycling. It has suffered through the economic downturn, only to find its position more dominant than before. The strength of the Harley-Davidson brand remains dominant as well, a fact acknowledged by even its fiercest critics. It’s a brand that has powered The Motor Company through 110 years of triumph and turmoil – world wars, economic crisis and generations of American riders.

Over the century H-D eclipsed its status as a simple motorcycle manufacturer to become an American institution. And even that plaudit doesn’t give due justice to the saturation of Harley-Davidson in popular culture. It’s a realization that hits me, oddly enough, while staring at Fricke’s eclectic assortment of black leather jackets…

The museum delivers a heady dose of nostalgia. Exhibits show the progression of H-D mounts and engine platforms through the years. Visitors see bikes the company built for both World Wars. There are the false starts of unsuccessful models, proudly displayed next to the blockbusters. The marque’s racing success is also chronicled, from the board track years and beyond, including evolution to Flat Track and early road racing success.

Popular museum exhibits, like the Evel Knievel display, demonstrate the broad influence of the H-D brand. Yes, Evel rode other marques too, but it’s Harley-Davidson to which he is forever linked. Like H-D, Elvis and the black leather jacket, Knievel is a persona that transcends into the shared American psyche. Even kids who never got within spitting distance of a motorcycle worshiped the daredevil extraordinaire mystique – the hard case from Butte, who drank Wild Turkey from his walking cane, broke more bones than, well, anyone, and rode the wheels off a Harley-Davidson motorcycle.

As we tour the museum, Fricke proves an ideal guide. He is a professional historian that happens to be a Harley-Davidson employee, not the other way around. As such, the tour steers clear of heavy company spin. And over its 110 years, H-D has slogged through its fair share of disappointment and crisis, to contrast the flush times.

Now it looks to climb its way out of the Great Recession. This latest economic downturn is just one of many the company has survived, and not the worst. In fact, The Great Depression can be credited to H-D’s dominance of the domestic market as the dire economic straits of the 1930s culled a once robust roster of American motorcycle manufactures. Only H-D and its traditional rival, Indian, survived – the latter marque doomed to eventual post-war failure, before subsequent revival attempts.

Harley-Davidson did not fail, of course. And despite the economic setbacks of the past five years, its hegemony in the domestic market is even greater than before. While unit sales have declined, nearly cut in half from the boom years, H-D’s market share has grown. Company profits, after falling into the red, are back up too, thanks to restructuring and production changes implemented by CEO/President Keith Wandell. Changes we would see firsthand visiting the engine factory at Pilgrim Road.

Ways to Save on Motorcycle Insurance

Given the high price of replacement costs of bikes and automobiles and ever-increasing medical costs, driving without motorcycle insurance is a bad idea.

Not only that, riding a motorcycle without insurance is illegal and the fines are substantial.

Consider following some money-saving tips, insuring your bike doesn’t have to cost a fortune.

1. Raise Your Motorcycle Insurance Deductible
While this will cost you if you ever have an accident or loss, raising your deductible just a few hundred dollars could save you as much as 30% on motorcycle insurance.

2. Skip the Small Motorcycle Insurance Claims
Insurance is designed to protect against substantial losses, not minor fix-it claims. If your claim is minor, consider fixing it yourself and keeping your motorcycle insurance rate low.

3. Look for Motorcycle Insurance Discounts
Do you take your bike out for a spin every month or so when the weather’s nice? If so, you may be able to save money on your motorcycle insurance. Many insurers offer part-time or occasional driver discounts.

4. Exclude a Certain Individuals from Your Motorcycle Insurance Policy - BUT BE CAREFUL WITH THIS IDEA! When it comes to riding a motorcycle, not all drivers are created equal. If someone in your household does not ride, you might consider excluding him or her on the bike coverage. HOWEVER – NEVER, NEVER, NEVER LET THAT PERSON TAKE OFF ON YOUR BIKE. FOR IF A LOSS OCCURS WHEN HE OR SHE IS OUT FOR A RIDE – YOU ARE SCREWED!

5. Keep a Healthy Credit Score and Save on Motorcycle Insurance
You may think your credit score doesn’t affect the rate you pay for motorcycle insurance, but you’re mistaken. A poor credit score can raise your rate more than a speeding ticket, so keeping your credit score high will help keep motorcycle insurance rates low.

6. Check Your Driving Record for Errors
Believe it or not, the motor vehicle bureau does make mistakes every so often. Check over your driving record every so often to catch mistakes.

7. Avoid Sport Models
No Offense to the Metric Racers. The style of bike may be more important than the cost, so choose wisely Motorcycle insurance companies place heavy surcharges on bikes deemed high-risk, such as sport and supersport models. In some states, sport models can cost four times as much to insure than a standard cruising model. Do your research before you buy.

8. Drop Comp and Collision Coverage on Older Bikes

It may not make financial sense to drop Comp and Collision on your old beater.

Dropping Comp/Collision may save big on motorcycle insurance.

BUT YOU SHOULD ALWAYS MAKE SURE YOU KEEP OR HAVE PIP and UM/UIM COVERAGES, for ¼ Texas drivers are Uninsured.

And odds are they are paying less attention to the road than you are !!!!

TEXTING & DRIVING AND TEXAS LAW

Unlike the majority of the states across the country, texting while driving is not currently illegal in the State of Texas.

Auto accidents across Texas have injured or killed hundreds, if not thousands where the responsible drivers are found to have been texting and driving.

In 2011, Governor Perry vetoed a bill that would have prohibited texting in driving throughout the State of Texas. Governor Perry claimed that Texas should not micromanage people's behavior.
Some believe that he Vetoed the Law last time because of the Cell Companies giving his re-election campaign money.

NEW DEVELOPMENTS:

The state legislators are once again seeking to have some sort of distracted while driving bans established that would hopefully limit drivers from texting behind the wheel.

Rep. Craddick is among a half dozen legislators have filed or re-filed new bills for the 2013 Legislative Session seeking a statewide ban on texting while driving.

Although the proposed bills vary, all of them look to placing restrictions on the use of handheld wireless communications while driving. The bills are gaining momentum in the Legislature and could pass again.

Currently, with the exception of drivers in school zones, novice drivers, and school bus drivers, there is no statewide prohibition on using your cell phone and texting while driving in Texas.

Specifically, the following laws are currently in place:

• Drivers under the age of 18 are not allowed to using their cell phone at all while driving --meaning they cannot text, surf the Internet, or place calls.
• Drivers are prohibited from using handheld devices in school crossing zones.
• New drivers with Learners Permits may not use handheld devices during the first six months of driving
• School bus drivers are not allowed to text or use any other form of hands free devices while behind the wheel with passengers ages 17 or under.

Best Western and Harley Davidson Motor Co. extend travel partnership for another three years.

The Best Western Hotel Chain and U.S. motorcycle maker Harley Davidson Motor Co. originally inked a marketing and travel partnership in 2006. That deal includes Best Western hotels and motels in Harley Davidson tours and motorcycle rental promotions.

Best Western is also the official lodging partner for Harley’s 110th anniversary this year.

The new deal extend the partnership for another three years.

Best Western has more than 4,000 hotels worldwide. The company already has 1,200 Harley- and biker-friendly motels and hotels in the U.S. and Canada.

Best Western offer motorcycle wipe-down towels, washing stations and Harley riders and customers can enroll in special Best Western rewards programs.

“Most importantly, this partnership brings great benefits and on-the-road conveniences to our riders and fans,” said John Farris, director of global brands alliances for Milwaukee-based Harley (NYSE: HOG).
